3 accused awarded 2 yrs imprisonment for attacking a friend

Jammu, Aug16- After nine years of investigation and trial the Chief Judicial Magistrate Jammu YP Bourney awarded two years imprisonment and fine of Rs 2000 to each namely Rajesh Kumar, Ajay Kumar and Bachan Lal for attacking one Manjeet Singh with sharp edged weapon.

CJM, after hearing CPO Pawan Khajuria for the State and Advocate Shabil Mirza for the accused persons and going through the statement of witnesses including the doctor and the Investigation Officer, observed that in the given circumstances accused do not deserve to be given the benefit of the provisions of probation of offenders act. Accused are sentenced to undergo imprisonment for one year each for offence u/s 324 RPC and to pay fine Rs 2000 each and imprisonment of another one year for offence u/s 4/25 Arms Act. All the sentences shall run concurrently, the Court ordered.

According to the prosecution case on September 9, 2001, few boys of the locality were playing cards and injured was amongst them. While playing, the boys had an argument with his brother and all the three accused got infuriated and started abusing. Some persons intervened and dispersed them. At about 8.30 PM when Manjeet Singh was returning home, all the three accused, after prior preparation and common criminal intention, stopped Manjit Singh and attacked him. The accused Rajesh Kumar was armed with kirch with which he attacked in his belly and caused injuries. On hue and cry the elder brother of the injured rushed on spot. The accused Rajesh Kumar attacked Nirmal Singh also. Police registered a case u/s 307/34/341 RPC r/w section 4/27 Arms Act and started investigation. The offence u/s 324/326 RPC came to be added after the receipt of Medical report and after completion of the investigation challan was filed on January 25, 2002. JNF
