Rly employee convicted in fake recruitment scam

JAMMU, Mar 9: For the gross misuse of the authority he enjoyed as confidential assistant to railway recruitment board chairman in 1992, a senior railway clerk was today convicted in a fake recruitment scam by a court and awarded nine years rigorous imprisonment.
The fraud was detected in 1992 and investigation in the case was completed by the anti-corruption wing of CBI in 1994. Ramesh Kumar was posted as confidential assistant to the then railway recruitment board chairman, Jammu, from March 1992 to September 1992.
Being the confidential assistant, the board stamps and seals, including the stamp bearing the word "SELECTED", remained in his custody.
During his tenure as confidential assistant, applications were invited by the board for different posts. After undergoing written test, qualifying candidates were called for interview and, accordingly, a Merit List of selected candidates was issued under signatures of the Chairman. The Final Select List, called Panel, was sent to the Ferozpur Railway Head Office through a board representative, who used to obtain receipts on the office copy of the Panel for official records.
Ramesh Kumar, while taking the select panel to the Ferozpur railway office, submitted the genuine panel along with fictitious Panels prepared and forged by him. As a result of this, various candidates whose names figured in the fictitious list were also issued appointment orders.
However, when this fraud was detected, their appointment orders were cancelled forthwith.
Following about two-year investigation in the case, a chargesheet under sections 420, 467, 468, 471 & 201 of RPC was filed by CBI against Ramesh in the court of Chief Judicial Magistrate, Jammu on July 24, 1994.
The trial of this case was conducted by CBI's senior public prosecutor, S K Bhat.
After successful trial, CJM (Special Magistrate, CBI Cases) convicted the accused today and sentenced him to undergo a rigorous imprisonment for 5 years under section 468 of RPC and rigorous imprisonment for 4 years under sections 420 and 471 of RPC.
A fine of Rs 5,000 was also imposed on the accused for each offence. As all the sentences have been ordered to run consecutively, the accused has to undergo a total imprisonment of nine years and has to pay a fine of Rs.15,000 for all the offences.
The case was investigated by Inspector SL Kaul CBI Jammu who was on deputation from J&K Police to CBI and the said officer is now SP in J&K Police.
