HC directs SRTC not to recover Rs 23.85 lakh from ex-employee | | | EARLY TIMES REPORT JAMMU, May 14:High court judge, Justice M A Mir has directed the state road transport corporation (SRTC) not to effect the recovery of Rs 23.85 lakh from the pension of a retired employee of the corporation. The court directive came in a writ petition filed by Shah Mohammad (63), who retired from SRTC as Inspector in March 2006, through advocate Anil Sethi. Shah was assigned the job of inspecting accidental SRTC vehicles. Even as no inspection fee was to be charged under the SRTC rules from those whose vehicles had met with accidents, Shah was alleged to be charging it "illegally". Since the petitioner was alleged to have issued the fraudulent mechanical inspection certificates on five occasion, SRTC alleged that his this conduct had caused it a loss of Rs 23.85 lakh. SRTC notice in this regard was issued to him on May 1 this year, which said that the amount would be deducted from his monthly pension. Shah then moved the high court, challenging the SRTC order. In its direction, the court said that subject to objections from the other side, SRTC was directed not to effect the recovery of Rs 23.85 lakh from the pension of the petitioner. "It is, however, made clear that this direction only relates to the monthly pension of the petitioner and not in respect of other retiral benefits," the court added.
