Corruption allegations not proved, VOJ files case closure report

Jammu, May 15: Vigilance Organization Jammu (VOJ) in case of corruption against then XEN R&B Basholi BD Khajuria has filed closure report in the Court of Special Judge Anticorruption as case has not been proved. According to the VOJ case the outcome of the verification dated June 23, 2007, the allegation against BD Khajuria, then Executive Engineer R&B Division Basholi who by misusing his official position has conferred undue benefit to his wife in getting pecuniary benefit for himself by allotting construction work in his division on exorbitant rates.
On a complaint VOJ started verification which revealed that tendering process was dishonestly manipulated to facilitate allotment of work to contractor Chanchal Khajuria executive engineer at a highly exorbitant rate. The verification further reveals that accused had sufficient knowledge that the work to Chanchal Khajuria was being allotted on highly exorbitant rate as the allotment order of other similar work was issued by executive engineer himself only. In this manner BD Khajuria in league with his wife and other officials has abused his official position with dishonest intention under a conspired plan conferred undue benefit of lacs of rupees to his wife. FIR NO 23/2007 a registered in P/S Vigilance Organization Jammu and investigation was entrusted to Ashok Samyal DySP.
During the course of investigation search in premises of Govt quarter Basholi and in residential house at Sanjay Nagar Jammu, different teams were constituted to conduct. During search of said premises at Sanjay Nagar some documents pertaining to the landed property, bank pass books, passport etc and a cash of Rs more than 78000 were recovered and seized on spot. In a search conducted at Basholi, some documents pertaining to the LIC Policies of the accused and his family members, one Scorpio and a cash of Rs 70,000 were seized on spot. BD Khajuria was arrested on November 17, 2007 and was brought Jammu on November 18, 2007 and compliance report was submitted before the Court. His medical examination was conducted; the accused was bailed out by Special Judge Anticorruption Jammu on November 23, 2007. Chanchal Khajuria contractor also obtained anticipatory bail on November 28, 2007. BD Khajuria has moved a representation before the Vigilance Commissioner J&K in which he has stated that a false and frivolous case has been registered against him regarding allotment of work in the open competition below the estimated cost which has no loss to the state exchequer, nor he has abused/misused his official position. He has further represented that a similar work was allotted to another contractor Tilak Raj below 55% of estimated cost in open competition following due proceed of tendering. The said representation also been considered during the course of investigation and after considering the comparative statement, the rates of Chanchal Khajuria were found lowest at the estimated cost of Rs 8 lacs and the work was allotted to Chanchal Khajuria by then Executive Engineer Basholi BD Khajuria. The similar work at the same place was also out to tender for execution of work in construction of road by way of earth work cutting/filling, the proximate estimated cost at the said work was calculated RS 9 lacs, for this work the five contractors offered their tenders. During the investigation no evidence has come forth to prove that the other tender documents of the contractors were manipulated but after three years investigation the VOJ found that there is no evidence to corroborate the allegations of FIR as the rates of contractor Chanchal Khajuria cannot be compared with rates offered by Tilak Raj and in other similar work as the said Tilak Raj had not completed the execution of work despite of more than 2 years and has abandoned. Therefore, the case was closed as "Not Proved" and sent to Central Vigilance Office for approval, Commissioner Vigilance Vide NO SVO/FIR-23/2007/J-526 dated January 9, 2010 ordered approval for closing the case as "Not Proved". Today the closure report submitted before the Court of Special Judge Anticorruption Jammu for further orders. (JNF)
