Prepare seniority list of AEEs: HC | | | Early Times Report Jammu, May 20: The high court directed the state not to make any promotion to the post of Assistant Executive Engineer till the seniority list was prepared. A single bench of the court comprising Justice Sunil Hali issued the direction today. The petitioners Sarfraz Ahmed Choudhary and Ors were appointed as Assistant Engineers. Soon after their appointment, the respondent bifurcated the candidates belonging to Jammu Division & Kashmir Division and thereafter allocated the wings to all the candidates including the petitioners. The petitioners alleged that the respondents without formulating the seniority of the Assistant Engineers were contemplating further promotion of favourites to the post of Assistant Executive Engineers. The post of Assistant Engineer is a state cadre post and is governed under the J&K Engineer Gazette Service Recruitment Rules 1978. Justice Sunil Hali after hearing the petitioners who were represented by Advocate MK Bhardwaj and Advocate Ajay Abrol observed that it seems persons appointed came to be allocated different wings and no joint seniority list has been issued by the respondents. The contention of the petitioners is that the respondents are required to issue joint seniority list in terms of Rule 24 of J&K Civil Service (classification, control & appeal) Rules 1956. The court issued notice to the respondents' returnable within four weeks. In the meantime respondents were directed to prepare the seniority list of Assistant Engineers in terms of Govt order No 419-PW(R&B) 2007 dated December 31, 2007. Court directed that till seniority was prepared in terms of said order, no further promotion to the post of Assistant Executive Engineer should be made. The court clarified that this order is however, subject to objections from the other side. ----JNF
