Ban on banquet halls to continue for 3 months | | | JAMMU: The high court today extended ban on eighty-five banquet halls in Jammu for another three months. A division bench of the court comprising Chief Justice Dr Aftab H Saikia and Justice Sunil Hali extended the ban in the `best interests of the general public'. Pertinent to mention, the high court banned unauthorized banquet halls on May 22 last year. However, the court modified the order and allowed the banned halls to operate till December 31, 2009. After the said period the ban became operational yet again. The court imposed restrictions on the banquet halls to ensure safety of the people and smooth movement of traffic around the halls. The Pollution Control Board was directed to ensure noise level within permissible limits. The board was authorized to seal any hall incase any violation of the prescribed norms was reported. The owners were urged to have fire extinguishers available in the halls. Advocates SK Anand and A Kapoor appeared for the petitioners and M/S DC Raina, MK Bhardwaj and Sunil Sethi Senior Advocates and Advocate SK Raina appeared for the applicants. The court order makes it mandatory for the owners of the banned banquet halls to licenses under section 324 of Municipal Corporation Act. The state has to set norms for running of banquet halls. These directions have been issued in a various CMPs filed by the people who found the halls ill equipped to cater to needs of the clients and the society in general. In one of the petitions filed by one Puran Chand and others, it was submitted that some banquet halls were operating without permission from the municipal authorities. It was also submitted that such banquet halls subject the general public to inconvenience. JNF
