HC stays promotion of ED Bank employee | | | Early Times Report Jammu, May 26: The high court has stayed the promotion of an employee of the Elaquai Dehati Bank. A single bench of the court comprising Justice Sunil Hali passed the direction today. Senior Advocate Sunil Sethi appearing for the petitioner submitted that in terms of the rules governing the promotion of Regional Rural Bank's (appointment & Promotion of Officers and other employees) Rule 1998, promotion to the post of MMGS-III is effected on the basis of seniority-cum-merit. It was further stated that petitioner's name Girdhari Lal Bhat's name figures at Serial No 11 in the batch of 1980 whereas the name of Khurshid Ahmed Khan figures at serial No 13 in the batch of 1981, which is reflected from the list of Code Nos issued by the respondent's authorities. It was further submitted that the official respondents without taking into consideration the seniority position has passed an order of promotion in favour of Khurshid Ahmed Khan to scale-III, even though he is junior to the petitioner. It was stated that decision in this regard had been taken by the official respondents in the Board meeting held on May 17, 2010, but the copy of said promotion order passed in favour of private respondent has not been provided to the petitioner. The court after hearing the parties issued notice to the respondents. In the meanwhile subject to the objections by the other side and till further orders promotion of private respondents Khurshid Ahmed Khan to the post of MMGS-III shall remain stayed. Court also directed official respondents to provide a copy of promotion order passed in favour of private respondents to the petitioner before the next date of hearing. They shall also keep the record available on the next date of hearing relating to the proceedings conducted by them in making the promotion of private respondent. --- JNF
