Comply or DGP shall appear in person: HC | | | Early Times Report JAMMU, June 2: The high court today directed the state to file compliance report in a contempt petition by July 6 failing which the DGP has been directed to remain present personally on July 15. In a contempt petition filed by one Rajinder Kumar Bhardwaj seeking implementation of judgment of writ Court, Justice Sunil Hali directed the state respondents to submit compliance report by or before July 6, 2010, In case the needful is not done, the Director General of Police J&K Shall remain personally present in the Court on July 15, 2010. Justice Sunil Hali after hearing Advocate MK Bhardwaj representing the petitioner and AAG Jagdish Parihar representing the state respondent granted time to the state to file compliance report. Earlier a Division Bench upheld the judgment of the writ Court on November 20, 1998, the state was directed to treat the petitioners appointed against the post of Sub-Inspector in the executive armed police and to extend them the benefits of promotion notionally, taking the date of their first appointment for the purpose of seniority. The writ Court clarified that the petitioners shall not be entitled to any monetary benefit in terms of the arrears of the pay and other allowances. The present appeal was filed in the year 2000, the appellate, at no stage, during the pendency of appeal stayed implementation of judgment; as a result judgment has been implemented. The petitioners who came to be appointed as ASI on August 17, 1982 were treated to have been appointed Sub-Inspectors from August 17, 1982. The respondents have not complied with the order of the High Court forcing the petitioner to initiate contempt proceedings against them. —JNF
