HC directs Govt to consider 15 teachers for promotion

Jammu, June 4: The high court today directed the government to consider promotion of fifteen petitioners seeking promotion to the post of lecturers.
In two petitions filed by Ghulam Nabi & others and Vas Dev Sharma & Ors seeking promotion to the post of lecturer in the School Education Dept on the basis that petitioners have obtained their degrees of Post-Graduation from Madhya Pradesh Bhoj Open University, Justice Mohd Yaqoob Mir of Jammu & Kashmir High Court Jammu Wing issued notice state of J&K through Commissioner/ Secretary Govt School Education Dept and Director School Education Jammu returnable within four weeks.
The petitioners are presently working in the School Education Dept as Master/teacher.
They have been denied promotion as the government has taken a decision to promote only such candidates who fulfill the conditions laid down by the Supreme Court and decision taken by the University of Kashmir and Jammu in the light of judgment.
The petitioners alleged deliberate attempt by the respondents to deprive them of their right to seek promotion to the post of lecturer. The petitioners are eligible for the promotion for the promotion as post-graduation degrees obtained by them are duly recognized by the UGC/DEC. The petitioners were pursuing the said degrees prior to the pronouncement of judgment of Supreme Court.
The petitioners even otherwise also by no stretch of imagination can be deprived of their legitimate rights under the grab of notification issued by the University of Jammu dated October 5, 2005. It has been notified for the information of all concerned any course run by study center/ franchise of any University except IGNOU be not recognized. It is further submitted in the petition that the decision taken by University of Jammu is prospective in nature and by no stretch of imagination can come in way of petitioner who have admittedly got their admission and were pursuing the case in post-graduation prior to the issuance of the said notification.
Court after considering the facts mentioned in the petitioner has issued notice and directed respondents to consider the petitioner for promotion to the post of lecturer. (JNF)
