HC grants time to IG Crime for filing CD in murder case | | | Early Times Report Jammu, June 4: The high court today granted time to IGP crime to file case diaries in the much publicized murder of Ghulam Muhammad Rather, a National Confer-ence leader and childhood friend of former Chief Minister, Ghulam Nabi Azad. The IGP, Raja Aijaz Ali appeared in person today and sought time for filing the case diaries. Justie JP Singh accepted the request an adjourned the case with the direction to the registry to list it after ensuing vacation. The petitioner Ghulam Rasool Rather cousin of deceased Ghulam Rather, filed a petition in which he stated that FIR No 22/2007 u/s 302/341/109 RPC registered with police station Gandoh and monitored by the coordinate bench of this Court, in view of the fact that initially reluctance was shown by the said police station to go a head with the investigation. During the course of proceedings, various reports were filed by the investigating officers supervising the investigation vide order dated December 30, 2009. The High Court observed that existence of prima-facie evidence establishing commission of offences punishable u/s 302/341/109 RPC against the accused. A stay order restraining the prosecution from filing the challan was vacated. The court directed the concerned to file the challan in the competent court. While the challan was to be filed, the respondents transferred investigation to CBI vide SRO 92 dated March 2, 2010. The petitioner stated that intent and purpose of the said SRO was to defeat the directions of the high court seeking filing of challan. The high court accordingly stayed the SRO on April 21, 2010.
