CJM entrusts enquiry to Passenger Tax judge

JAMMU: Soon after the judge small causes expressed his inability to investigate Wamiq Farooq case, the Chief Judicial Magistrate (CJM) entrusted the enquiry to Passenger Tax judge. The judge has been directed to submit his report by July 30.
The judge small causes, Ajay Kumar returned the file on the grounds that he was totally unaware of Kashmiri language. "On May 25, Ghulam Muhammad Bhat got his statement recorded. I had taken help of my Nazir as the witness could not speak any other language. It is not proper for me to investigate case where I have to depend on others especially in a case which is of sensitive nature."
The CJM today perused the case a fresh. He said the complaint filed by the relatives of Wamiq Farooq states that on January 31 around 4.45 p.m, Wamiq a student of 7th standard got killed when a police officer fired a tear smoke shell at him. According to the complaint the government has admitted that the fatal smoke shell was fired without any provocation or reason. Accordingly the aggrieved relatives went to police station Rainawari and Nowhatta but no FIR was registered.
The police also held an enquiry and accused Wamiq of being a habitual stone pelter. The relatives of the deceased strongly contested the police report and filed a petition in CJM's court at Srinagar seeking a direction to the police to register a case under section 302 RPC against the erring police men.
The CJM observed that the statements of the eye witnesses and the police report contradict each other completely. Accordingly an enquiry was ordered.
The CJM directed the Passenger Tax judge to record the statements of witnesses and submit a detailed report by July 30.
Wamiq's killing evoked massive protest demonstrations across Kashmir. For five consecutive days the Valley observed shut down. Clashes left around 200 persons including fifty police men wounded.
