| HC stays investigation in kidnapping case | | | Early Times Report
Jammu, June 14: Vacation Judge Jammu & Kashmir High Court Jammu Wing Justice JP Singh today stayed the investigation in FIR No 77/2010 registered at Police Station Mendhar u/s 366/109 RPC.
Petitioner Mohd Shabir and his wife has filed a petition seeking quashment of FIR No 77/2010 at P/S Mendhar saying that Mohd Irshad Mir has managed filing of FIR against the petitioners as he was not happy with the marriage which his daughter-petitioner NO 2 had solemnized with petitioner Mohd Shabir out of her free will. Petitioners appeared along with their counsel Adv Hafeez-ur-Rehman stated that the allegations appearing in the FIR lodged by the father of petitioner No 2 were false and fabricated.
Justice JP Singh after hearing counsel for the petitioner observed that on the basis of the documents placed on record by the petitioners, which include statement of the daughter of the complainant recorded by Sub-Judge Srinagar on June 8, 2010, a case for admission of this petition has been made out and admitted the petition, issued notice to the respondents with the direction that until further orders from the Court, the investigation in FIR No 77/2010 shall registered at P/S Mendhar is stayed till next date of hearing.
