HC stays reversion of Naib-Tehsildar | | | EARLY TIMES REPORT JAMMU, JUNE-18 (JNF):- Vacation Judge of the state High Court (Jammu Wing) Justice JP Singh has stayed the operation of Deputy Commissioner Poonch’s reversion order dated June 2, 2010 for a period of six weeks and allowed the petitioner to look-after the routine work of Naib-Tehsildar Bimber Gali. The court issued notic to State of J&K through Chief Secretary, Commissioner/Secretary Revenue, Divisional Commissioner Jammu, Deputy Commissioner Poonch, Tehsildar Mendhar and private respondent and also allowed the petitioner to place copy of seniority list dated April 15, 2004. The petitioner Mohd Kabeer submitted that he was appointed as Patwari in the year of 1983 and has participated in the departmental examination and passed six papers. The respondents for smooth functioning of the department, petitioner was given promotion as Naib-Tehsildar on Stop-Gap arrangement. From the date of promotion, petitioner is working as Naib-Tehsildar Bimber Gali, but to the utter surprise of the petitioner, Deputy Commissioner Poonch has withdrawn the order dated April 26, 2010 whereby the petitioner was appointed as Stop-Gap arrangement as Naib-Tehsildar. This was on the representation of one Mohd Sageer Qaunon Go Mendhar. It is pertinent to mention here Mohd Sageer is Junior to the petitioner as he was appointed on July 6, 1986 and the petitioner was appointed on April 12, 1983. The petitioner prayed before the Court for quashment of the order No DLP/PA/360-63 dated June 2, 2010 passed by Deputy Commissioner Poonch whereby the respondent has withdrawn the order DLP/PA/180-85 dated April 24, 2010 whereby the petitioner is promoted as Stop-Gap arrangement as Naib-Tehsildar to look-after the work of Naib-Tehsildar Bimber Gali.
