GMC employee gets bail

JAMMU, June 21:
The court of Additional Sessions Judge Anticorruption Jammu, DC Sagotra today granted bail to Narotam Sharma an employee of Govt Medical College Jammu who was arrested on the direction of Minister for Medical Education RS Chib for charging Rs 5 for out-patient department registration slip instead of Rs 2.
While grating bail, the court perused the contents of the bail application, police report, CPO objections and observed that accused has remained in the police custody for more than five days which mean that IO of the case has already availed sufficient time for conducting investigation of the case. It is trap case and alleged tainted money have already been recovered from the accused-applicants and nothing remains to be recovered from him. Offence u/s 5(2) PC Act is punishable with imprisonment for a term which shall not be less than one year but may extend to seven years and shall also be liable to fine. As per police report applicant/accused is a Government employee which means accused/ applicant is permanent resident of J&K and having his moveable and immovable property in the State. Generally, a government employee is not supposed to flee from the trial of the case. No doubt the statements of prosecution witnesses are yet to be recorded u/s 164-A CrPC but prosecution witnesses are not subordinates to accused to whom he may influence or he may get them in his favour. With these observations Court accepted bail application of the accused and directed that accused to furnish bail bond to the amount of Rs 50,000 and personal bond to the same amount with the directions that he will remain present before the IO during investigation of the case as and when required.
According to the case accused an employee of record section of GMC hospital was detained by police on the direction of Minister for Medical Education Mr. RS Chib for charging five for OPD registration slip instead of Rs 2. The Bakshi Nagar Police arrested Narotam Sharma s/o Girdhari Lal and registered a case against him under the prevention of corruption act. JNF
