Narcotic smuggler acquitted as prosecution miserably failed

Jammu, July 8: 2nd Additional Sessions Judge, Jammu, Mr. Vinod Chatterji Koul acquitted Mohd Maqbool Raina R/o Fremoo Gadhol Tehsil Kokernag Distt Anantnag, who was facing trial under NDPS Act, as the prosecution miserably failed to prove charge against the accused beyond reasonable doubt and the challan is dismissed and accused is acquitted of the charges.
While acquitting the accused, the Court after hearing Additional Public Prosecutor appearing for the State and Adv AK Sawhney appearing for the accused observed that regarding the weight of charas, the statements of the prosecution witnesses is contrary, thus there are material discrepancies with regard to the material facts as such charge against accused cannot be said to have been established and Court held that the prosecution has miserably failed to prove charge against accused beyond reasonable doubt as such challan is dismissed and accused acquitted. Accused shall be set at liberty forthwith if not required in any other case, Court ordered. --JNF
