NC leaders murder: HC exempts IG crime from personal appearance

Jammu, July 9: In a much publicized murder case of NC leader Ghulam Mohd Rather, who also happened to be childhood friend of Mr. Ghulam Nabi Azadm presently Union Health Minister, Justice JP Singh of Jammu & Kashmir High Court Jammu Wing today exempted Inspector General of Police Crime J&K from personal appearance. Raja Aijaz Ali, Inspector General of Police Crime, J&K, who was present in the Court today and has stated to have filed statement of facts. Upon this Court directed Registry to place of the statements of facts on record and exempted IG Crime from personal appearance.
It is worthwhile to mention here that on July 10, 2009, State High Court directed Additional Advocate General that he shall ensure of IG Crime J&K in the Court on the next date of hearing and also issued notice to the IGP Crime to appear in person along with records and material on the basis he has directed closure of the case.
In the petition it has been submitted that the deceased Ghulam Mohd Rather happened to be childhood friend and class fellow of former Chief Minister of J&K Ghulam Nabi Azad. The petitioner and the relation of deceased approached the Chief Minister Mr. Ghulam Nabi Azad who belonged to the same area, as by that time sequence of events was clearly indicating a conspiracy having been hatched by one Abdul Rashid, brother-in-law of Mohd Sharief Naiz, former power minister presently MLC, his nephew Fiaz Mohd and Mohd Younis along with other private respondents under the guidance of Mohd Sharief Niaz for allegedly killing deceased Ghulam Mohd Rather.
In the petition it was further alleged the cause of the crime that pedestrian bridge which was on Nallah connecting Goilbar village has had lost its life, Azad was called upon by the deceased in secretariat and required about the construction of bridge and when deceased informed him that no funds have been allocated for the construction of bridge, the Azad, who was then CM was pleased to issue on spot instructions to the concerned to release the money for construction of that bridge.
Accordingly an amount Rs 2.80 lacs was got sanctioned. The bridge was to be got constructed through the agency of Panchayat Khaljugasar. It was alleged that Mohd Sharief Niaz former power minister and presently MLC earlier represented Bhaderwah constituency in which the area of Goilbar also falls and all the constructions local works in different Panchayats were in the meanwhile got executed on the instructions of Mohd Sharief Niaz through contractors who pledged their allegiance to him and his party.
The deceased had all this political affiliation with National Conference and on this issue it has been alleged deceased was murdered and seeking investigation of the case through CBI or team of Crime Branch headed by an Officer not below the rank of DIG.
Adv SS Ahmed appeared for the petitioner whereas Mr. KK Pangotra ASGI appeared for the Govt of India and Additional Advocate General Gagan Basotra appearing for the state whereas Adv PN Goja appeared for respondent. ---JNF
