HC grants bail to dowry death accused | | | early times report Jammu, July 10: The high court (Jammu wing) today granted interim bail to a dowry death accused. Justice Sunil Hali, who heard the petition granted four month interim bail to the accused with the direction that accused shall not influence the witnesses or intimidate those witnesses who are yet to be examined. The court observed that the prosecution can apply for cancellation of bail if it feels that the accused have in one way or the other influenced the witnesses. The deceased, Monika Choudhary, who happened to be the daughter-in-law of the main accused is stated to have consumed poisonous substance as a result of which she died on October 28, 2009. The deceased was married with accused Sandeep Kumar s/o Jagdish Kumar on March 3, 2009. Initial period of marriage is stated to have passed off without any complaint regarding demand of dowry by the accused. The harassment is stated to have started by the accused persons in the nature of demand of dowry and the deceased was harassed and physically tortured by them. According to the prosecution case a demand of Rs 1 lac was made after three months of marriage out of which Rs 50,000 is stated to have been paid by the father of the deceased with the promise to make balance payment shortly. The father of the deceased also promised to gift a car to her daughter's in-laws. The deceased was dropped at her father's house on October 19, 2009 by the accused Randeep Choudhary. The father and brother of the deceased dropped her back at her in-laws house with the promise to make other payment as soon as possible. She is stated to have consumed poisonous substance on the intervening night of October 27/28, 2009 and died on October 28, 2009. On receipt of this information the police preceded u/s 174 CrPC and after verification and enquiry FIR came to be registered on December 12, 2009 in P/S Vijaypur against the accused persons who were later taken into custody. The accused persons moved an application for grant of bail before 1st Additional Munsiff Samba, on refusal of the bail by the said Court vide its order January 8, 2010, the accused persons filed fresh bail application before Sessions Judge Samba who also rejected the bail application on January 18, 2010. Thereafter they approached the High Court where Advocate Sunil Sethi with Advocate Ravi Abrol represented them. Additional Advocate General SC Gupta and Advocate RK Kotwal appeared for the respondents. High Court granted bail to the petitioners for a period of four months subject to their furnishing of bail bonds to the tune of Rs 30,000 each with two sureties of the like amount to the satisfaction of Principal Sessions Judge Samba. ---JNF
