Insurance company officials acquitted in corruption case

JAMMU, July 12: Special Judge Anticorruption, Jammu, JR Kotwal today acquitted Kehar Singh, Branch Manager, National Insurance Company, Bari-Brahmana Branch and UK Handoo, Surveyor who were caught red-handed by CBI team.
According to CBI case on November 16, 2002 one Janak Raj lodged a written complaint in the office of CBI/ACB Jammu, alleging that accused Kehar Singh, Manager, NIC, Bari-Brahamana had demanded Rs 40,000 as illegal gratification from him for settling fire insurance claim of the shop at Railway Station Bari-Brahamana which was insured with NIC. The complainant further alleged that he met the Manager in his office last week, who assured him for settlement of his claim at Rs 2, 93, 000 but demanded Rs 40,000 as illegal gratification and instructed him to handover the amount to UK Handoo, Surveyor on or before November 18, 2002. Handoo when contacted has instructed the complainant to pay at least Rs 15000 as first installment and the rest amount after receiving the claim amount. On receipt of this complaint, a case u/s 5(2) r/w 5(1) (d) J&K PC Act and sections 161, 163 & 165-A r/w section 120-B RPC and constituted a trap team which caught accused red-handed. After completion of investigation, CBI presented challan on February 25, 2003 in the Court.
Special Judge Anticorruption, Jammu, JR Kotwal after hearing both sides and observed that the discrepant prosecution evidence creates a serious doubt about the genuineness of the recovery and cannot be held as sufficient to prove that the currency notes were lying with UK Handoo or were being counted by him at the time when trap team had entered the room or were within the control and were recovered from the table top of Branch Manager Kehar Singh. Court further holds that the evidence led by the prosecution fails to prove the case against the alleged accused persons and charges against both the alleged accused fails and they are held not guilty and acquitted from the charges leveled against them. -JNF
