Acquittal in two murder charges as alleged weapon of offence is doubtful

Jammu, July 19: THE 3rd Additional Sessions Judge, Jammu, Mr. RS Jain today acquitted Inderjeet Singh and Sat Pal Singh from the charges of committing murder of Ajmeet Singh as the alleged weapon of offence casts a doubt on the genuineness of the recovery at the instance of the accused.
The 3rd Additional Sessions Judge Jammu Mr. RS Jain after hearing Additional Public Prosecutor for the state whereas Advocates Anil Bargotra and Satinder Gupta appeared for the accused persons observed that the recovery of kirch by itself does not advance the case of prosecution that it was accused persons who committed the murder of Ajmeet Singh in the challan it has been mentioned by the IO that accused Inderjit Singh had made a disclosure that he destroyed the evidence as he had washed the blood from the Kirch with which the alleged murder was committed. In the said recovery memo it has been averred that a blood sustained kirch was recovered. This fact also caused a grave doubt on the genuineness of the recovery of the weapon of the offence at the instance of accused. The prosecution case becomes more doubtful when the report of FSL no blood was detected on the Kirch sent by the police to the FSL for examination in the present case. Court further said that all these factors costs a suspicion of doubt veracity and the genuineness of the prosecution case specially pertaining to the recovery of alleged weapon of offence at the instance of accused Inderjit Singh. In the present case prosecution has unable to prove a chain of circumstantial evidence which would lead to conclusion that it was accused persons and none else who had committed the murder of Ajmeet Singh and thus so called circumstantial evidence against the persons does not constitute a complete chain which is consistent with their guilt and in compatible with their innocence. It is this clear that prosecution has totally failed to bring home the charge against the accused persons and accordingly accused Inderjit Singh and Sat Pal Singh are acquitted from the charges leveled against them. --JNF
