POTA Court awards three years imprisonment to cop | | | early times report Jammu, July 20: Presiding Officer of Designated Court under Prevention of Terrorism Act (POTA) Mr. RS Jain today awarded three years imprisonment to one Fareed Ahmed, who was a police constable at the time when he was caught under POTA Act. According to the prosecution case, Farid Ahmed was a constable in police and was posted in District Udhampur . From September 29, 2001 till November 11, 2001, he remained absent from duty and resumed to duty on November 15, 2001. Ahmed in league with the militants gave a film for developing to Jaswant Singh of Sainik Studio, Poonch and the photos were seized by the police from the possession of accused. Though accused claimed that the film was given to him for developing and during investigation it was established that accused was giving shelter to the militants of Mahore area to spread militancy. Accordingly, accused was chargesheeted for offence u/s 3 of POTA. During his confessional statements which was recorded under the direction of SSP Poonch, he stated that he is a resident of Nahach, tehsil Mahore. In May-June 1998, he was employed in police and in 1999, he was transferred from Udhampur to Poonch. Four terrorists of his village whom he knew personally which included Abdul Gafaar, Ghulam Mohd, Jamal Din and Bahar Din used to come to his house occasionally. In July 1999, he had gone home on holiday when in the evening, Adbul Gafar, Gh. Mohd, Jamal din and Bahar Din came to his house and asked for Rs 50,000 as charity but he gave Rs 5000 to them. He also gave them food and they left . At times foreigner terrorists also used to come to his house with them. On September 29, 2001, he came home on 10 days leave and the same evening , some unknown terrorists came to his house and told him to do their work and get cigarettes medicine etc from the market. He agreed to do the same and giving the excuse of his wife being ill gave telegrams for extension of leave. During this period, he used to get articles for the terrorists. On November 2, 2001, the same five terrorists came to his house and gave him a negative film to develop and he along with the film reported for duty on November 8, 2001 and on November 12, 2001, he took the film to Sanik studio at Daruni and gave the same to Manjit singh who told him to take back the photos on November 15, 2001. His name was written on the register etc. On November 15, 2001 he was on duty in JK bank Poonch and went to take the photos and after giving Rs.80/- took 22 photos and the same was entered in the register by the photographer. As he came out along with the photo and negatives, he was apprehended by police of police station Poonch and took the 22 copies and film negative and seized the same. Mr. RS Jain Presiding Officer POTA Court after hearing both the sides and also referred the judgment of Supreme Court Titled Gurdeep Singh alias Deep Vs State of Delhi observed that In the view of the facts of the case and looking to the voluntary nature of his confessional statement, accused Farid Ahmed is sentenced to imprisonment for a period of three years and to pay a fine of Rs.1000/- under Section 3 (4) POTA. The accused who was present in Court and was on bail was taken into custody by order of the Court. ---JNF
