HC takes note of state functionaries for not complying with Court order

Jammu, July 20: In a contempt petition Justice Virender Singh of J&K High Court Jammu wing took serious note of the functioning of the state for not complying with the court directions and feel the necessity of taking up this matter to the notice of the Chief Secretary, J&K Govt sitting at the helm of affairs through Sr. Additional Advocate General, who is incidentally present in the Court for putting up his appearance in some other case. Sr. AAG SC Gupta stated that without wasting any time, would apprise Chief Secretary the concern shown by this Court with regard to the laxity being shown by the officials of the different departments in not complying with the order within stipulated period. Court issued show cause notice to all the respondents returnable within two weeks only to explain as to why contempt proceedings be not initiated against them for willfully disobedience of the order of dated November 11, 2009 by the Division Bench of this Court. This order has been passed by the Court in a contempt petition filed by Madan Mohan Sharma and others in which the petitioners filed the petition for relief of third in SITU promotion which was granted with a direction to respondent by the Court took comply the order within a period of three months. The petitioners assert that they brought to the notice of Controller Drugs by way of reminder dated May 31, 2010 to comply with the judgment. A copy sent to Principal Secretary to Govt Health & Medical Education Dept but no effect and this has constrained the petitioners to issue a legal notice upon the respondents through their counsel on June 15, 2010. This exercise also went in vain. The petitioners are said to be senior citizens. Upon this, the court appreciated the endeavors made by the counsel for the petitioners and took a serious note not only in the instant contempt petition which related to senior citizens, who in any case were entitled to the priority but the felt the necessity to take up this matter to the notice of Chief Secretary to the state and issued notice to all the respondents. In this contempt petition, Adv FA Natnoo appeared for the petitioners, KK Pangotra ASGI for the respondent Union of India and MA Bhat appearing for the state respondents. ----JNF
