After Shafi Uri, Omar Govt opens backdoor for CM's Advisor
BOPEE selects Mubarak Gul's urban daughter in Rural category for PG

SRINAGAR/ JAMMU, July 20: Chief Minister's Advisor, Mubarak Gul, has surfaced as the second top beneficiary of Omar Abdullah government's special benevolence for the ruling National Conference's politicians. Under influence from Chief Minister's Secretariat---more surprisingly without Chief Minister's knowledge--- Board of Professional Entrance Examinations (BOPEE) Jammu & Kashmir has selected Mubarak Gul's daughter, Safina Gul, for a post-graduate diploma in ophthalmology under the reserved "Rural" category inspite of the fact that she was neither in possession of the essential qualification (five years of continuous working in rural areas) nor had ever applied under any reserved category. Justice JP Singh of Jammu & Kashmir High Court today stayed Safina Gul's selection and issued notice, among others to CM's Advisor, for his alleged misuse of official position.
Undue favour by the state-controlled body to Mubarak Gul has come to the surface in days of the backdoor appointment of NC leader and Member of Parliament Mohammad Shafi Uri's son, Owais Shafi, as 'Editor' in J&K State Sports Council, headed by none other than Chief Minister Omar Abdullah.
Vide its notification No: 27/BOPEE of 2010 dated 17-05-2010, BOPEE selected 12 candidates in Open Merit category for MD, MS and PG Diploma in different medical and surgery disciplines in Jammu & Kashmir state's four medical colleges, namely Government Medical College Jammu, Government Medical College Srinagar, Sher-e-Kashmir Institute of Medical Sciences (SKIMS) and the privately run Acharya Shri Chander College of Medical Sciences (ASCOMS) Jammu. Twelve candidates were selected. One Dr Almin Shah, who was selected for PG course in pathology at ASCOMS, stood the last on the cut-off mark of 211. Mubarak Gul's daughter, Safina Gul, who was entitled to and applied under Open Merit category, failed in the selection as she stood at 139 in order of merit.
Vide annexure '2' of the notification, BOPEE notified 16 candidates as qualified and entitled to selection for the said courses in different reserved categories subject to availability of seats and counseling. According to the notification, seven candidates shortlisted and invited for counseling included Dr Mangat Ram, Dr Chander Prakash, Dr Masooda, Dr Rauf Hussain, Dr Mohammad Akhtar Mirza, Dr Amita Gupta and Dr Rinchin Angmo.
Surprisingly, when the final selection Notification No: 30-BOPEE of 2010 dated 29-05-2010 came out, it was observed that BOPEE had completely ignored Dr Akhtar Mirza, who figured at serial number 5 of the candidates invited for counseling, and BOPEE had instead selected Dr Safina Gul D/o Mubarak Gul, who had neither been invited for counseling nor had ever applied for the reserved "Rural category". Among the 25 candidates selected for PG degree and diploma in reserved categories, Dr Safina Gul, with her 139 marks in Open Merit category, was found to have been selected at serial number 22 for PG Diploma in Ophthalmology at GMC Srinagar.
Aggrieved candidate, Dr Akhtar Mirza, approached BOPEE for redressal of his grievance by way of termination of Dr Safina Gul's backdoor selection and, subsequently, sought his own selection for the vacancy. He complained that Dr Safina had neither put in five years of qualifying service in rural areas as a doctor nor had she applied under this or any other reserved category. On the other hand, Dr Akhtar Mirza was not only declared as qualified for the reserved "Rural" category but was also invited for counseling. While nobody at BOPEE satisfied him with an answer, he was constrained to approach J&K High Court for termination of the wrong selection and prayed for his selection against the vacancy.
Officials at BOPEE told the aggrieved candidate "unofficially" that Chairman and Controller had been put under "tremendous influence" from Chief Minister's Secretariat and Dr Safina Gul's selection was a result of the misuse of official position by Chief Minister's Advisor and the selected candidate's father, Mubarak Gul. Gul is NC's four-time MLA from Iddgah constituency of Srinagar and in his capacity as CM's Advisor he is holding status and protocol of a Cabinet Minister. Bureaucratic sources, however, insisted that Chief Minister had no knowledge of the misuse of official position by his Advisor.
On Dr Akhtar's writ petition, Justice J P Singh of J&K High Court today stayed the selection of Dr Safina Gul and issued notices for filing of their objections to Chairman and Controller of BOPEE, Principal GMC Srinagar Dr Shahida Mir, respondent selectee Dr Safina Gul and Chief Minister's Advisor, Mubarak Gul. Next date of hearing was fixed in first week of August.
As exposed by early Times in a recent scoop, NC-led government had similarly created a post of 'Editor' in J&K State Sports Council for the senior NC leader Mohammad Shafi Uri's Class 12th pass and overage son, Owais Shafi, and got him appointed through backdoor without three hours of the special creation on April 29th, 2010, when Darbar was moving from Jammu to Srinagar. In this case too, Chief Minister Omar Abdullah, who is the competent authority in his capacity as Chairman of Sports Council, had been kept completely in the dark by the Minister incharge, Secretary Sports Bashir Ahmed Runiyal and Secretary Sports Council, Shameem Ahmed Laharwal.
