Rape case: Bail plea rejected | | | early times report Jammu, July 22: District Judicial Mobile Magistrate, Doda, Mr. Pawan Kumar Sharma today rejected the bail application of Mohd Amin who was involved in a alleged rape case. According to police case, one Bahadur Singh lodged a written report on July 4, 2010 with the police station, Doda in which he submitted that he was working as SPO in District Ramban and his wife was living Tehsil Doda. On July 1, 2010 when she had gone to attend the marriage of real brother, the accused in connivance with other accused took the prosecutrix in the lonely area and committed rape upon her. The accused also took away gold ornaments which she was wearing at the time of occurrence. The case was registered u/s 376/343/392 RPC. Accused Mohd Amin had been arrested by the police and other accused was absconding. Objections were also called from the prosecution. In the objection, the prosecuting officer said that offences are non-bailable and non compoundable. The investigation is still in progress and seeking dismissal of bail application. Judicial Magistrate Mr. Pawan Sharma while dismissing the bail application held that the statement of prosecutrix recorded u/s 164-A CrPC prima-facie appeared to made that a case against the accused u/s 376/392, 366 RPC, the accused who has stated in application that they are ready to surrender in the Court except Mohd Amin who is already in custody but neither of the accused had surrender in Court and nor appeared during the proceedings despite given assurance by the counsel for the accused for producing the same. Keeping in view the facts and circumstances of the case, Court is of the opinion that accused deserves no leniency from the Court and rejected the bail application. JNF
