Insurance Co asked to pay over Rs 10 lakh to complainant

Jammu, July 22: State Consumer Disputes Redressal Commission, Jammu comprising Justice GD Sharma (rtd) its President and Mr. BL Saraf, its member in a complaint filed by one Jai Dev Sharma of Gandhi Nagarm Jammu Vs National Insurance Company and Ors seeking compensation of a sum of Rs 12, 61, 622 from the Insurance Company, directed National Insurance Company to reimbursement for a sum of Rs 10, 57, 758 and 50 paisa which are the actual expenses incurred by the complainant with interest @8% PA from the date of filling the complainant till final payment is made, along with litigation expenses Rs 6000. The complainant in the year 2008 had gone to Australia. Before embarking upon the journey, he obtained medi-claim insurance cover for himself from National Insurance Company Branch, Shalamar, Jammu which was effected from January 13, 2008 to March 12, 2008. During the insurance, all the formalities was completed, however, before his plane could take-of, he suffered Epigastric and chest discomfort. He was taken to Prince of Wales Hospital Barker, Street Randwick, Australia where he was checked and after complete checkup he was allowed to go his home. The complainant informed the Insurance company for rebursement of his mediclaim. SCRF after hearing both sides observed that the arguments of counsel appearing for the complainant and perused the record, the allegations made in the complaint have supported by the complainant in his affidavit and as well as two witnesses. The complainant has proved its case of rendering deficient service to him as well as carrying unfair trade by the respondents. The Commission accordingly allowed the claim of complainant and directed National Insurance Company to reimbursement for a sum of Rs 10, 57, 758 and 50 paisa which are the actual expenses incurred by the complainant for his treatment with interest of 8% along with litigation expenses 6000/-.
