Habeas corpus petition of Gola Shah dismissed, seeks compensation for detention period | | | EARLY TIMES REPORT JAMMU, July 27 (JNF): Justice Hasnain Massodi of Jammu & Kashmir High Court Jammu Wing dismissed a habeas corpus petition in which the Gola Shah was detained under Public Safety Act on September 22, 2006 and revoked the detention by the Govt order dated November 15, 2006 as the State Advisory Board declined to confirm the detention order. Ravinder Gupta alias Gola Shah in the petition has challenged the detention order on the grounds that the preventive detention of the detenue was ordered for a period of two years when a person could be detained on the ground of his activities pre-judicial to public order for a maximum period of one year. It is further alleged that preventive detention was outcome of land dispute between the Gola Shah and the Vijay Singh Sambyal, SSP, then posted in VOJ, that the detenue had complained against the said respondent to his officers and the detention order slapped on the detenue was to silence the detenue and prevent him from prosecuting the complaint against the said respondent.
