| HC stays suspension and transfer of RED AEE | | | EARLY TIMES REPORT
JAMMU, July 27: Justice Sunil Hali of Jammu & Kashmir High Court Jammu Wing has stayed the transfer order and suspension of AEE Ashok Kumar Pargotra of Rural Engineering Department (RED) posted in the sub-division Banihal.
This order has been passed in a petition filed by the petitioner challenging his transfer and subsequently suspension on the ground that respondent Javed Iqbal Wani filed certain frivolous complaints against the petitioner in order to ensure his suspension regarding which various representations have been filed by the petitioner to the higher authorities. It is on the basis of said frivolous complaints the suspension and transfer order has been passed against the petitioner with a collateral purpose just to adjust the respondent Javed Iqbal Wani.
It is immediately after placing the petitioner under suspension, the said respondent has been made Incharge of the Sub-Division where the petitioner was posted.
Justice Sunil Hali after hearing Adv Abhinav Sharma appearing for the petitioner observed that the contention of the petitioner could have been rebutted by the respondents by filling objections, however, despite the fact that notice was accepted by Adv Deepika Mahajan appearing for the State on July 17, 2010 and time was granted for filling objections, no one has put the appearance on behalf of the respondents. Even objections, have not been filed in view of the submissions made by the counsel for the petitioner taking into consideration the fact that respondents have chosen not to appear or to file objections, Court directed that till the next date of hearing order impugned suspension and transfer of the petitioner shall remain stayed. --- (JNF)
