Enquiry panel set up to probe civilian killings
Relief, job package for next of kin, detenues to be released

SRINAGAR, July 27: In a bid, apparently to pacify the anger and rage among the masses over loss of human lives in recent violence in parts of Kashmir Valley, the NC led coalition government today announced a Commission that will investigate around 17 killings which happened during last one month. The coalition government which appears to in the 'damage control mode' and prepared to walk an 'extra mile', in diffusing the situation back to normal gear has also decided to release political leaders and other detenues in a phased manner after review committee meant for the purpose of looking into the cases will give its report.
Both the decisions which are being viewed as significant in terms of the 'efforts' of state government to ensure restoration of normalcy at the earliest were approved unanimously by the cabinet today. The Cabinet which met here today under the Chairmanship of Chief Minister, Omar Abdullah approved constitution of Commission of Inquiry under the Jammu and Kashmir Commission of Inquiry Act, 1962 consisting of Justice Syed Basher-ud-Din (Retd) as the Chairman and Justice Y.P. Nargotra (Retd) as a member to inquire into all the 17 incidents in Kashmir division in which fatalities had occurred on account of action by the State Police/Security Forces since June 11 this year. The Commission will submit its report within three months.
The Cabinet approved that the Review Committee constituted vide Government Order No. Home-2501-(PB-V) of 2002 dated 26-12-2002 will immediately review the cases of detention under the Public Safety Act and make recommendations about the release of detenues. This will also incorporate the cases of senior separatist leaders who are likely to be released shortly, sources said.However, no individual names came in for discussion during the meeting.
Besides setting up of the Committee, the cabinet also approved a package, as a one time exception, in favour of the NoKs of those civilians, who have lost their lives since June 11 ,as a result of violence attributable to the breach of law and order and are not found directly or indirectly involved in actual violence or instigation .The package includes ex-gratia relief of Rs one lakh, appointment of an eligible member of the deceased civilian in Government service against a lowest non-gazetted post or payment of cash compensation of Rs 5 lakh including Rs one lakh ex-gratia relief in lieu of Government job.
A committee comprising the Deputy Commissioner and the District Superintendent of Police of the concerned police shall ascertain and certify the non involvement of the deceased civilian/NoK to be appointed in actual violence or instigation thereof. Accordingly, the concerned Deputy Commissioner shall accord sanction to the grant of ex-gratia relief and also to the appointment of an eligible family member of the deceased civilian or payment of cash compensation in lieu of Government job to the NoKs, as the case may be.

Sources said on all these decisions there was unanimity within the cabinet members belonging to both National Conference and Congress party. Even as the Chief Minister Omar Abdullah had been talking about government's intention to enquire into the killings, as many as 17 during the last over one month which flared up the tensions across the valley, it was during the All Party meeting that was convened by the state government some 15 days back where the leaders belonging to various parties emphasized upon the need to probe into the circumstances which resulted in these unfortunate incidents. Inclusion of this in the cabinet agenda is being seen as seriousness on part of the government to implement what emerged from the much published All Party meeting held recently.
