Sex scam: Court assails CBI for failing to serve notices on witnesses in Sgr | | |
EARLY TIMES REPORT JAMMU, July 29: Taking serious note of the absence of prosecution witnesses (PWs) in the alleged Kashmir sex scandal, special judge (CBI), Chandigarh, Wednesday strongly assailed the investigating agency for its failure to serve the court notices on PWs in Srinagar. Earlier, the court said bailable warrant of Ghulam Mohammad Begh and summons of Firdosh Ahmad, Ansar Ahmad and Riyaz Ahmad Langoo remained unserved on them due to the paucity of time as the Srinagar branch of CBI had received them on July 27 last, ie only a day before the court hearing yesterday. CBI special public prosecutor R K Handa also stated that the warrant and summons could not be served on the PWs because of the disturbed conditions in the valley.Defence counsel Aiyaz Ahmad Bhat, who hails from Srinagar, however, contradicted Handa, saying there was absolutely no restriction on police to serve the court notices on the PWs during curfew restrictions in the valley. Now the curfew too had been lifted for the past 20 days, he added.The court said it was surprising that the notices, issued on July 5, had taken 22 days in reaching Srinagar. "Even the CBI plea that that process could not be served due to disturbed conditions carries no substance as there can be no restriction on the movement of police for carrying their official duties," the court observed. "Thus it shows the callous attitude of the prosecution in serving the court process which is highly depreciated," the court said and added, "Fresh bailable warrant of Ghulam Mohammad and summons of PWs -- Firdosh, Ansar and Riyaz -- be issued for September 20, 2010." The court said if the statements of all the witnesses could not be recorded on September 20, the case would also be taken on September 21. Long date was given by the court on the request of the accused, who said they would be observing Ramzan from August 10 to September 10 and hence not be able to attend the court during the Ramzan days as Srinagar was more than 600 km from Chandigarh, the court said. The court directed to depute an officer not below the rank of a Sub-Inspector of CBI for service of the process.
