Amandeep murder : HC extends bail of Jagar Singh | | |
Early Times Report Jammu, July, 30:In an application filed by Jagar Singh seeking extension of bail, it is submitted that the petitioner was granted interim bail for a period of three months by this Court vide order dated May 3, which is to expire on August 2. It is stated that the conditions laid down in the order at the time of grant of interim bail by the Court have not been violated by the petitioner. It is on this basis submitted that interim bail granted in favour of the petitioner may be extended. This application is being contested by the respondent state on the ground that the petitioner has tried to intimidate the witnesses, which is ground for cancellation of interim bail issued by the Court in favour of the petitioner. The respondents have also filed an affidavit on behalf of Abdul Rouf Lone who was in charge of Special Investigating team. In the said affidavit, it is stated that the petitioner has threatened eye-witness Tej Pal Singh who is also filed a complaint in P/S Gandhi Nagar in this behalf. It is further contended by the respondents that the Special Leave Petition have been filed before the Apex Court by the respondent as also by the alleged accused persons in which notices have been issued. Justice Sunil Hali after hearing counsels observed that after passing the order passing the order by this Court on May 3, no new facts had emerged in the case except that SLPs have been preferred by the parties before the Apex Court and one complaint has been filed by the eye-witness Tej Pal Singh before the concerned police station alleging that he is being threatened by the petitioner and accused party. Court told at the bar that the matter is being take-up by the Trial Court for framing charge, but the presiding officer stands transfer. Upon this, the Court directed the petitioner that he shall approach the Trial Court regarding extension of interim bail granted in his favour. The application, if any, filed in this regard by the petitioner shall be taken-up by the Trial Court on August 11, 2010 and the matter shall be considered in view of the conditions laid down by this Court on May 3, 2010. State High Court ordered that till then the interim bail shall continue.
