Contempt notices served on chief secy, JMC commisioner, tehsildar | | | EARLY TIMES REPORT JAMMU, Aug 1: High court judge, Justice Hakim Imtiaz Hussain has issued notices to chief secretary S S Kapur, Jammu Municipal Corporation (JMC) commissioner Mubarak Singh and tehsildar S S Chib in a contempt petition filed by Anshu Sharma. The court also directed the JMC commissioner to file compliance report of the earlier order by next date of hearing of the case.In his petition filed through advocate A K Sawhney, Anshu prayed for issuance of a Writ of Mandamus, directing Kapur, Singh and Chib to perform their statutory duties and conduct demarcation of 15 marlas of land falling under khasra No 49 Min at Rehari near J&K Education Board in halqa Jammu Khas and land (of respondent No 5) falling under khasra No 741 Min in halqa Toph Sherkhania and further prayed to implement the Order dated December 15, 2009 bearing No 4354-59/08 wherein a commission was appointed to conduct nishandei of the land. The petitioner submitted that respondent Darshan Singh Ghai started interfering in his land with an intention to grab it and created dispute, claiming that the land, which actually falls under khasra No 49 min, belongs to him under khasra No 741 Min Khewat No 98 Min khata No 629 min at Toph Sherkhanian. On February 2, 2010, the high court had directed the parties to maintain status quo with respect to the land. The SSP, Jammu, was directed to implement the directions and report compliance within one week.The order was served upon the SSP personally on the evening of February 2. The petitioner said Ghai had started violating the court orders with impunity from law by raising construction at the disputed land. He said the respondents had violated the court order and degraded it. Therefore, they were liable for punishment under Contempt of Courts Act, he submitted.
