| Court directs SSP VOJ to book police officer | | | early times report
Jammu, August-04 (JNF):- Additional Sessions Judge Anticorruption Jammu DC Sagotra directed SSP Vigilance organization Jammu to lodge FIR against accused Girdhari Lal Sharma then ASI Incharge Police station Akhnoor under law in a case of sodomy.

This direction has been issued in a complaint filed by one Babu Ram Village Mawa Karora Tehsil Akhnoor District Jammu in which complainant submitted that in the January 2008, he went to police station for registering of FIR against one Vikram Kumar in a case of Sodomy. It was alleged in the complaint that ASI Girdhari Lal Sharma who was functioning as Incharge Police Station Akhnoor demanded Rs 1000 for registering the case. On great persuasion by the complainant it was settled at Rs 500 which paid to him. Then ASI after accepting the bribe amount registered a case u/s 377 RPC against Vikarm Kumar.
The court on March 9, 2009 forwarded the complaint to SSP VOJ for holding an enquiry with the direction to file a case if the allegations were substantiated . The status report was to be filed within a period two months.
The status report mentions that in the course of verification statements of the complainant and other witnesses were recorded. The witnesses corroborated the statement of the complainant. But thereafter the report is silent. It has not been written in as to why FIR has not been registered even after recording the statement of the witnesses against accused Assistant Sub Inspector when he was functioning as Incharge P/S Akhnoor.
The VOJ was directed vide order March 9, 2009 to file the status report in the court within a period of two months but the order has not been honoured in letter and spirit. Therefore, at this stage in place of taking any action against SSP VOJ and to avoid all discrepancies, it will be better to pass a direction to lodge FIR against the accused.
The court after hearing Advocate . DC Sagotra after and Advocate Narinder Kumar Attri appearing for the complainant in the present complaint filed on May 11, 2010 ordered that in continuation to order March 9, 2009 of this Court and keeping in view the verification conducted by Inspector Javid Ahmed Khan of VOJ, SSP VOJ directed to lodge FIR against accused Girdhari Lal Sharma then ASI under law and to conduct the investigation of the case as required under law. With this order Court disposed of the present application filed by complainant. JNF
