CBI seeks closure of Skimmed Milk Powder scam | Recommends administrative action against accused under Army Act | | EARLY TIMES REPORT Jammu, Aug 5: The Central Bureau of Investigation (CBI) has finally filed a closure report in a court of Special Judge Anti-Corruption Jammu after investigating fake transportation of 105 MT of skimmed milk powder worth Rs 67.43 lakhs from Military Farm Jammu to similar farms in Ambala, Jallundhur and Ferozpur during 2002-2003. The CBI report, however, held the accused liable of administrative lapse and recommended action under Army Act. It took the country’s premier investigating agency 18 months to reach this conclusion. The CBI revealed in the FIR that 19 Mts of skimmed milk powder had been shown falsely dispatched from Military Farm Jammu to Military Farm Ferozpur vide vehicle registration No JK02G-7385 and JKR-9313 on January 8, 2001. The vehicles, however, turned out to be a motorcycle and Bajaj Scooter as per the record of the RTO Jammu and said accused officers claimed fake transportation charges of Rs 24700 and thereby defrauded the Govt exchequer.. The FIR further revealed that 40.9 Mt SMP was falsely being shown dispatched from Military Farm Jammu to Military Farm Jallandher as no vechile had been deployed for transportation of the said consignment. Moreover an amount of Rs 27000 had been fraudulently shown paid as transportation charges and the said amount in fact was misappropriated. It has been further alleged that 35 MT SMP has been falsely shown dispatched from Military Farm Jammu to Military Farm Ambala through Vehicle HR-37-7715 for which no transportation charges have been raised and paid. On the other hand for dispatching 25 MT of SMP to Military Farm Ambala neither any vehicle has been deployed nor any transportation charges raised. On this source information CBI registered a case u/s 120-B RPC r/w section 420, 409, 468, 471 RPC and 5(2) r/w section 5(1) (c) of J&K PC Act 2006 BK against then Major Kuldeep Singh and MIlkhi Ram then Assistant Supervisor Incharge Store and unknown officials of Military farms on February 18, 2009. The investigation conducted by the CBI has failed to prove the case and filed closure report in the Court of Special Judge Anticorruption Jammu, in which CBI submitted that the evidence available in this case it is established that material was received by the Military Farms Ferozpur, Ambala and Jallundhar directly from the firm. The Then Major presently Lt. Col Kuldeep Singh and Milkhi Ram had shown material dispatched from Military farm Jammu with the sole purpose to take on record the said Skimmed Milk Powder in their documents, so that payment was adjusted by the Military Farm Jammu which were authorized to procure consignments and adjust the payment to the firms. The payments have not been directly received by Military Farm Jammu but book adjustment vide receipt issued vouchers. The allegations that material of SMP to Military Farms of Western Commands Ferozpur, Ambala and Jallundhar were not dispatched and same were misappropriated are not proved. On the basis of the evidence that the material stands properly received and reflected in the records of aforementioned military farms. However administrative lapse on the part of Lt. Col Kuldeep Singh then Incharge Military Farm Jammu and Milkhi Ram then Store Incharge Military Farm Jammu are clearly established for preparing AD Notes to show skimmed milk powder having been sent from Military Farm Jammu vide false J&K trucks Numbers as proved by RTO record. This modus operandi was adopted by the Army Officials to bring the said dispatches on their records for purpose of payment and adjustment to the firms and to avoid any audit irregularities. In view the Administrative Action under Army Act was recommended against Lt Col Kuldeep Singh then Incharge Military Farm Jammu and Milkhi Ram then Store Incharge Jammu . The CBI prayed for closure of the case.
