HC directs respondents to restore benefit of KAS in favour of petitioners

Jammu, Aug 6:In a petition filed by VN Gupta and others who were inducted in Kashmir Administrative Services (KAS) vide Govt order dated September 23, 1997, the date when said order was issued, the petitioners already superannuated from service. After lapse of four years vide communication dated July 12, 2001, the petitioners were informed that their induction in KAS was not made in accordance with rules. It is contended respondents that the names of the petitioners erroneously been included in the list of officers inducted in KAS and subsequently order dated January 9, 2001, their names were deleted from the Govt order dated September 23, 1997.
Justice Sunil Hali after hearing both sides observed that no body has appeared on behalf of respondents today to contest this petition. The plea taken by the counsel for the petition is that the petitioners were eligible for induction in KAS on January 1, 1996, the date when the selection processes were initiated by the respondents. The process could not be completed in view of the inter-se dispute between various officers of different services. This according to the petitioners cannot deny them their right for being inducted in the KAS after the selection process was initiated. The petitioners have placed on record the Govt order dated September 18, 1991 and July 9, 2004 which revealed that induction in Kashmir Administrative Service has been allowed in favour of some officers who had not only retired but had expired.
High Court, further, observed that the respondents clearly understood the fact while issuing order dated September 23, 1997 by which the orders of induction were issued in favour of the petitioners in pursuance of Rule 9 holding them eligible and entitled for being inducted in the KAS on the basis of vacancies which were available on January 1, 1996. High Court rejected the plea of the respondents that the petitioners cannot be inducted in KAS as they had already retired from service. On their own showing the process for induction of the petitioners in KAS was initiated on January 1, 1996 at on that date petitioners were in service.
With these observations, State High Court allowed the petition and order dated January 9, 2001 set-aside and directed the state to restore the benefit in favour of the petitioners which was given to them in terms of Govt order No 1532-GAD of 1997 dated September 23, 1997. JNF
