RTI: JKP denies info on flimsy grounds | Applicant running from pillar to post in absence of SIC | | EARLY TIMES REPORT JAMMU/SRINAGAR, Aug 7: Maintaining a distance from the transparency law, the Jammu and Kashmir Police rejected an RTI application seeking copy of video recording of a recruitment rally for the post of sub inspector in Auxillary Police unit conducted in the winter capital of the state and held on June 6, 2009. The RTI applicant, Naresh Kumar, a resident of RS Pura, Jammu had also appeared in the recruitment rally and claims that he had qualified all the physical tests but because of an intervention of a senior police officer his candidature was rejected showing him failed in the 100 mtr race. It is pertinent to mention here that the entire recruitment process was videographed to ensure transparency and avoid unnecessary allegations. Surprisingly, when Naresh Kumar sought a copy of the videography of the recruitment rally from the state police, firstly he did not get any reply for more than six months, his RTI application dated Oct 10, 2009 was finally rejected on April 21, 2010. The rejection order stated “ As per our information , the entire outdoor events were recorded by a video camera but no CD was prepared either in full or in parts. Moreover, the record being confidential and pertaining to selection was forwarded to PHQ by DIG, Jammu. “ The rejection order further read as “ on scrutinity one mini- digitial video cassette was found received from DIG. However, there is no such system or mechanism available in this section through which 100 meter event can be bifurcated out and recorded on a VCD”. The rejection order keeps contradicting itself, the applicant is not told the clause or reason for rejection of his RTI application, whether it was denied on the pretext of “ confidentiality” or because of the non availability of professional mechanism. The applicant, Naresh Kumar under section 9 of the J & K RTI Act 2009, preferred an appeal against this order of the PIO, he filed an appeal before authority on April 29, 2010 but again showing disregard to provisions of the RTI Act, his appeal was rejected on July 20. It is pertinent to mention that under the provisions of Jammu and Kashmir the reply must be given/rejected within 30 days and by the same way the appeal shall be disposed of within 30 days. But in the present case of Naresh Kumar neither the PIO concerned bothered to abide by the provisions of JKRTI Act nor the Appealete authority adhered to the transparency law. It is irony that at one stage the state police claims total transparency but when it comes to deliver, then hiccups. Like Naresh, there are many other RTI applicants who are also at the mercy of the bureaucrats as the State Information Commission is still headless .
