HC stays attachment of Dental college supt | | | EARLY TIMES REPORT Jammu, Aug 7:- Justice Mansoor Ahmed Mir of Jammu & Kashmir High Court Jammu Wing today the stayed the attachment order of Dr. Mohan Singh, Superintendent,Govt Indira Gandhi Dental College, Jammu, who was attached with the Director Health Services vide order dated August 4, 2010 passed by Principal Secretary Health & Medical Education at the behest of Minister for Medical Education In the petition filed through Adv SK Shukla in which it has been submitted that Minister got annoyed with the Dr. Mohan Singh and was looking for an opportunity to deal with him. A selection committee comprising 10 members, including petitioner as Member Secretary and Principal Indira Gandhi Govt Dental College Jammu as Chairman came to be constituted vide order dated April 28, 2010 for making selection of doctors who have done BDS, for the posts of Registrar/Demonstrator, tutor and house officer. Respondent NO 5 was also one of the members of the said committee being the Head of Department of Periodentics and selection was conducted and merit list drawn. It was alleged that Minister after going through the select list could not find the names of interested persons in the list and he kept the select list in abeyance vide order June 30, 2010. Thereafter vide order NO 373-HME of 2010 dated July 14, 2010 cancelled the list and constituted a fresh committee for making selection of candidates and to enquire into the selection already made, respondent No 5 who was also member of the earlier committee, again came to be made a member of fresh committee and he has also been asked to enquire into the earlier selection made. Virtually respondent No 5 has to make enquiry against himself also. The selected candidates challenged the selection order and obtained stay in terms of interim order passed by the High Court on July 21, 2010. It was alleged in the petition that Minister after noticing the said interim direction issued order dated July 14, 2010 whereby drawing and disbursing powers of the petitioner came to be withdrawn. The petitioner challenged the said order in the High Court, the respondents sought and were granted time to file objections. In the meantime the respondents in order to render the petition infructuous have issued another order dated August 4, 2010 whereby the petitioner was attached with the Director Health Services Jammu. It was submitted that the impugned order has been made on the basis of so called order audit inspection report relating to the year 2007-2008 and 2008-2009 which is factually incorrect and the observations made by the audit inspection committee were deleted and no action was ever suggested or recommended by the said committee, but Minister made the said report as a base to breck his personal vengeance. After hearing both the sides Justice Mansoor Ahmed issued notice to respondent, AG Mr. MI Qadiri with Deputy AG Mrs. Shahista Hakim waived notice on behalf of respondents 1 to 4 to reply within two weeks. The notice shall go to respondent 5 & 6 within two weeks. In the meantime subject to objections from the other side and till next date of hearing the operation of impugned order, so far as it relates to attachment of the petitioner is stayed. JNF
