Misappropriation case: VOJ files closure report as case not proved

Jammu, Aug 9 : Vigilance Organization, Jammu after investigating a case for more than 2 years against then XEN , three AEEs, 4 JEs in a case of alleged misappropriations of Rs 4, 57, 109 as labour charges for the works restoration of water supply in Doda Circle, filed closure report as the case is not proved.
In the final report, it has been submitted a joint surprise check was conducted to verified allegations of misappropriation of funds by the officials of PHE Division Doda during the year 2005, the funds were released in the wake of heavy snow fall for restoration of water supply in hydraulic circle Doda.
A random check of 23 works of total 68 repair works revealed that Ghulam Mohd Bhat, then Executive Engineer in league with other officials of PHE Division, Doda under a conspired plan drew an amount of Rs 4, 57, 109 as labour charges and dishonestly misappropriated it. It was found that the accused public servant by abusing their official position and resorting to falsification of the record shown engagement of works, it were revealed during the course of joint-surprise check the restoration works were carried by the locals on voluntary basis without receiving any wages. The public servant has therefore, alleged fraudulently and dishonestly by resorting to manipulation of record drawn an amount of Rs 4, 57, 109 as labour charges when no labour was actually engaged by the officers of the said division for restoration of water works in that area. Accordingly, FIR was registered June 12, 2008 and investigation was taken-up. During the investigation it was revealed that 73 labourers were engaged who have received the payment against the work done by them but one Ranjeet Kumar s/o Dharam Singh r/o Village Barshala Tehsil & District Doda did not work as labourer but his name stands in the master-sheet and has not received by the payment mentioned on the receipt. In other case one Niaz Ahmed received Rs 560 for work of eight days @ 70 per day not for work of 28 days as shown on the master sheet also shown the name of some other persons who had received less payment as shown against them. VOJ after conducting the investigation revealed that in view of the evidence collected that officers/ officials of the PHE Division Doda have made the payment to the labourers mentioned on the master sheets and villagers of respective area did not work on voluntary basis as alleged in FIR.
The allegations of non-payment of wages to labourers could not substantiate, during course of investigation except one statement which support the allegations of instant case. VOJ recommended Chief Engineer PHE Jammu for appropriate action against eight officers of PHE Division Doda, so the present case is closed as not proved and filed closure report in the Court of Special Judge Anticorruption Jammu.
