HC directs DGP to constitute special team

Jammu, Aug 13: The High Court has directed the DGP to constitute a special team to investigate death of Brigade Major Randeesh Dogra. The highc court passed this direction in a petition filed by the deceased Major’s father, JL Dogra. The applicant submitted that Brigade Major Late Randeesh Dogra was posted as Brigade Major with Mountain Brigade at Kotranka, which was a militancy affected area. The petitioner further submitted that as per the report of Army lodged with the police, the death of his son has taken place on August 27, 2003 within the Brigade Residential Complex. The cause of death has been shown to be bullet injury and as per army version death has been caused due to accidental fire. According to the petitioner deceased had been murdered and that he has not died because of accidental fire which is apparent from the fact that there was guards posted on all the four sides where the alleged occurrence had been taken place but no sound of fire was heard by the Guards as per the police report, the petitioner in these circumstances seeking CBI Investigation.
Justice Hakim Imtiyaz Hussain after hearing the parties held “After having gone through the contents of the petition and also the case dairies, the Court does not find that the matter has been dealt within a proper manner by the police concerned and in view of the pleas raised and in view of circumstances which appears in the case, Court directed the Director General of Police to constitute a Special Team headed by a SSP to look into the issues which arise in the case as also into the issues raised by the petitioner. The proceedings be initiated a fresh and concluded within a period of three months from the date such a special team is constituted by the Director General of police and do not find it necessary to refer the matter to the CBI at this stage. With these observations and orders disposed this petition. JNF
