Delhi High Court declines anticipatory bail to consultant | | | EARLY TIMES REPORT Jammu, Aug 18: Justice AK Pathak of Delhi High Court has declined to grant anticipatory bail to Vivek Duggal who was booked State Viiglance Organization in FIR No 5 and 27 of 2009 registered under prevention of corruption Act. State Vigilance Organization has registered FIRs alleging that officials of J&K Handicrafts corporation had entered criminal conspiracy with Vivek Duggal, a Delhi based consultant, to dishonestly and fraudulently organize the so-called participation of J&K Handicrafts Corporation in Carpet Oasis Fair, Dubai and thereafter defraud the exchequer by making false claims. It was alleged that the participation of J&K Handicrafts Corporation in the event Carpet Oasis, for which funds had been sanctioned, was not organized and J&K Handicrafts Corporation was alleged to have entertained false bills of Vivek Duggal to the tune of Rs. 39 Lacs. In the bail application filed by Vivek Duggal through Advocate Sumita Kapil in the Delhi Court, the petitioner submitted that some key office bearers of the J&K Bar Association stand arrested by J&K Govt on account of which the legal community is not appearing before the concerned courts in Srinagar. It was argued, that the personal liberty of Dugal be protected so that he has adequate time to take appropriate remedial measures in Srinagar in regard of his legal rights and remedies. Court after hearing in detailed submissions of. AAG of J&K Gaurav Pachnanda, with Sunil Fernandes, Advocate-on-Record, regarding gravity of the allegations against Dugal, the Delhi High Court gave an option to counsel of applicant to either suffer a detailed order of dismissal or voluntarily withdraw the bail application. With these observations Court dismissed the bail application. JNF
