HC stays transfer of doctor

Jammu, Aug 19: In a petition filed by Dr. Nirmolak Singh Sports Medicine Specialist GMC Jammu who was transferred from GMC Jammu and attached with Director Health Services, Jammu, Justice Mansoor Ahmed Mir of Jammu & Kashmir High Court (Jammu Wing) today has issued notice to State of J&K through Commissioner Secretary Health & Medical Education, Principal GMC Jammu, Dr Dara Singh HOD Ortho GMC Jammu and Mr. RS Chib Minister for Medical Education, Technical Education, Youth Services & Sports returnable within four weeks.
After hearing Advocates BS Salathia and DS Chouhan appearing for the petitioners, the court ordered that subject to objections from other side and till next date of hearing the operations of order impugned dated August 2, 2010 and August 3, 2010 so far as the same related to the petitioner shall remain stayed.
The petitioner had leveled allegations against Minister of Medical Education, Technical Education, Youth Services & Sports and since the assumption of his office has been pressurizing the petitioner to adjust/accommodate the undeserving persons in the Sport Field as well as football association as the petitioner is General Secretary of Boxing Association and Vice President J&K Football Association.. It was further alleged that Minister of Medical Education started playing politics and day in and day out caused interference in the affairs of the sports as well as the Association. The petitioner along with other sport persons resisted and did not yield to the pressure of the concerned Minister. In view of resistance shown by the petitioner and his fellow office bearer in the sports field by not accommodating the undeserving persons.
The said minister started holding a grudge against him and in clear terms conveyed to the petitioner that he has to face consequences of daring to defy his directions. It was further submitted by the petitioner that when he left for Canberra Australia for Oceania Boxing Championships where he was appointed as Technical Delegate by the International Boxing Association on August 2, 2010 and came back on August 11, 2010 to Jammu, the petitioner, was informed that he was transferred and asked to report the office of Director Health Services Jammu. Principal GMC vide his order dated August 3, 2010 in pursuance to the order August 2, 2010 directed the petitioner to report to Director Health Services Jammu. The petitioner submitted both the orders transferring and reliving him issued in his absence on the direction of Concerned Minister and prayed for quashment of both the orders. JNF
