Bhim Singh calls on President | | | Early Times Report Jammu, August 24: Chairman of National Panthers Party that called on Pratibha Devisingh Patil, the President of India at Rashtrapati Bhawan besides extending its greetings on Rakshabandan presented a petition on the horrifying situation prevailing in Kashmir Valley following 65 day old bandhs and counter strikes, curfews, closures by administration and counter-closures by the public, which has resulted into a total anarchy, insecurity, lawlessness and non-governance in the state. The Panthers Party Chairman Bhim Singh urged the President to call for Governor’s report on the situation which the President is competent to do under Section 92 of the Constitution of J&K which provides that, if at any time the Governor is satisfied that a situation has arisen in which the Government of the State cannot be carried on in accordance with the provisions of this Constitution, the Governor may by proclamation assume to himself all or any of the functions of the Government of the State and all or any of the powers vested in or exercisable by anybody or authority in the State make such incidental and consequential provisions as appear to the Governor to be necessary or desirable for giving effect to the objects of the proclamation, including provisions for suspending in whole or in part the operation of any provision of this Constitution relating to any body or authority in the State provided that nothing in this section shall authorize the Governor to assume to himself any of the powers vested in or exercisable by the High Court or to suspend in whole or in part the operation of any provision of this Constitution relating to the High Court. Bhim Singh submitted before the President of India that she has a discretion to call a report from the Governor under the given situation and if satisfied concurrence may be given to the President to invoke sub-section 1 of Section 92 so that the Governor may take appropriate action for the revival of constitutional machinery in the State which has literally failed to function in accordance with the Constitution. The Panthers Party Chief further submitted that this authority in the President of India has been vested by virtue of Section 92 of the autonomous Constitution of Jammu and Kashmir and is not subject to any provision of the Constitution of India. The President, therefore, draws power from the Constitution of J&K and is empowered to exercise presidential authority to grant concurrence to the Governor of J&K to promulgate Governor Rule in J&K. Bhim Singh also urged Governor that the youth of Kashmir Valley are not against the nation but their anger is only against the corrupt, inefficient and authoritarian government of J&K headed by youthful Omar Abdullah. He urged the President’s intervention at the earliest in the interest of India’s security, unity and sovereignty vis-à-vis Jammu and Kashmir. He said that the President gave him patient-hearing while expressing concern on the ongoing turmoil in the Valley.
