8/25/2010 11:10:42 PM
EARLY TIMES REPORT
Jammu, Aug 25: Justice JP Singh of Jammu & Kashmir High Court (Jammu wing) in a petition filed by Sanjay Kumar in the year 2006, has directed the state respondents to pass appropriate orders for petitioner’s engagement as Rehbar-e-Taleem in primary School Reyar with effect from the date when because of non-joining of private respondent No 7 & 8, he became entitled for such engagement. High Court further directed the respondent that they shall pass requisite orders in this behalf within a period of one month.
The petitioner had applied seeking engagement as ReT in primary school Reyar-Malhar, he figured serial No 9 of the panel prepared for engagement. Those figured at serial NO 7 & 8 of the panel did not join and petitioner thus become entitled to engagement as Rehbar-e- Taleem Teaching Guide being next candidate in panel.
Justice JP Singh after hearing both the sides that respondents have not denied petitioner’s entitlement to engagement as ReT Teacher in primary school Reyar, where a vacancy is still existing. They have, however, not spelt out any reason justifying their inaction so long for depriving the petitioner of his right to engagement as ReT. The damage done to the petitioner because of in action of the respondents, therefore, needs to be remedied and directing his engagement with effect from the date when non-joining of candidates appearing serial No 7& 8 of the panel; he becomes entitled to such engagement and Court directed state to engage the petitioner.
