HC awards Rs 2.50 lakhs to student | | | Early Times Report Jammu, Aug 28: Justice Mansoor Ahmed Mir of J&K High Court (Jammu Wing) in an appeal filed by J&K Board of School Education against compensation awarded by the District Judge Bhaderwah to a student whose result of 10+2 was withheld by the Board and declared on April 15, 2004 upheld the award of Rs 2.50 lacs with the observation that student has lost two years and five months of his carrier due to negligence of J&K State Board of School Education. The court further held: “His class-mates have made a march ahead, some of them have completed graduation and even some have got appointment, but the student/respondent has been deprived and is lagging behind due to the negligence of BOSE. Awarding lump-sum amount of Rs 2.50 lacs as compensation/damages is nothing. Money cannot compensate two years and five months the life of the student. Court questioned had his result been declared in time, he would have made a march with his batch-mates, Had he got an employment as Class IV employee, he would have been earning Rs 5-6000 Per month. Or, had he completed graduation in time, he would have gain status and that would have created hope for him to receive higher education and to get a chance/opportunity for appointment against a Higher post, but because of the Negligence BOSE, the life of Farooq Ahmed Bhat a student has been made miserable. So by guess work, Court is of the view that plaintiff/respondent was entitled to damages/compensation to the tune of Rs 5 lacs, but Trial Court has only awarded Rs 2.50 lacs which the plaintiff has not questioned. Thus the finding returned and compensation awarded by the Trial Court is upheld and the appeal filed by the Board of School Education is dismissed. JNF
