HC directs PSC to interview aspiring Munsiffs

Jammu, Aug 30 (JNF):- Justice JP Singh of Jammu & Kashmir High Court (Jammu Wing) in three writ petitions filed by Ashiya Asgar, Monika Dutta and Vikrant Sharma, has directed the Jammu & Kashmir Public Service Commission to hold the interviews of the petitioners too along with other candidates, short-listed for interview for J&K Civil Service (Judicial) Competitive Examination 2009 and the results of petitioners shall however remain subject to the orders in CMPs.
In the three petitions in which Advocates Abhinav Sharma and Shivani Jalali appeared for the petitioners whereas Advocate DC Raina with Advocate FA Natnoo appears for the Public Service Commission, Court issued notice to the respondents. Advocate Natnoo accepted notice on behalf of PSC.
Court observed that the petitioners having been permitted to participate in J&K Civil Service (Judicial) Competitive Examination 2009 by the J&K PSC and shown to candidates short-listed for interview, succeeded in making out a prima-facie case for issuance of interim direction to PSC to interview the petitioners too, pending determination of the pleas raised in the petitions questioning the PSC’s decision not to permit the petitioners interview on the ground that they are ineligible to seek selection in view of issuance of notification dated December 13, 2008 in terms whereof, although the last date of receipt of applications had been re-notified as December 22, 2008 but the cut of date for determining the eligibility had to remain unchanged. Court directed PSC to hold interviews of the petitioners. JNF
