| 7 yr RI to rape accused | | |

Doda, Apr 19: The Court of Additional Session Judge Doda today awarded 7 years rigorous imprisonment to a rapist under Section 376 RPC with a fine of Rs 5000. The accused has further awarded 6 months rigorous imprisonment each under section 341/323 RPC. In default of payment of the under section 376 RPC, the accused shall further undergo a rigorous imprisonment for two months.
The brief facts of the case are that on 23rd June 2005 at 2 30 pm while prosecutrix was on her way to collect fruit apricot, as she happened to pass through the house of one Bashir Ahmed, where accused Abdul Latif was staying on rent. The accused wrongly restrained her and took her forcibly in the room and committed upon her. Though she tried to free herself but got hit on the head while being dragged by accused and got unconscious. The accused committed rape upon her for one half and hour .
As she regained her conscious the accused had fulfilled his lust. The Presiding Judge Tahir Khurshid Wani Raina observed that the prosecutrix has very candidly targetted the accused in her evidence before the court and medical evidences also fully corroborated the statement of the prosecutrix. |
