| DB issues directives in PIL regarding ban on sale and construction on Khad | | | Early Times Report
Jammu, May 5: in a much publicized PIL regarding inaction on the part of the State in implementing the Jammu and Kashmir Water Resources (Regulation and Management) Act, 2010 in which earlier Division Bench stayed the sale and construction in the areas of water body and sale of land concerning the bed of the river and the land recorded in the revenue records as Khad, Division Bench of State High Court Comprising Justice Hasnain Massodi and Justice Janak Raj Kotwal today took serious note of the state that despite adequate and reasonable opportunity state has not filed their reply and Sr. AAG SS Nanda appearing for the state seeks time and Division Bench granted four weeks' last and final opportunity to file reply.
In an application seeking vacation of stay order of sale and construction of Khad, Division Bench observed that it would be appropriate to deal with application only after state disclosed their stand and in the meanwhile earlier order by Virtue this Court stayed the sale and construction in the areas of water body and sale of land concerning the bed of the river and the land recorded in the revenue records as Khad is in force as on date to continue till next date of hearing. |
