Mughal Maidan Tehsildar put on penalty notice
SIC directs inspection of Revenue records

Jammu, May 15: The State Information Commission has directed Tehsildar of Mughal Maidan in Kishtwar district to allow an RTI applicant to undertake inspection of some revenue record which according to applicant was not provided to him under the J&K Right to Information Act 2009 (J&K RTI Act) . As the Tehsildar who is also the designated Public Information Officer (PIO) under State RTI Act has caused unnecessary delay in providing the said information to the RTI applicant, the State Information Commission (SIC) has put him on the penalty notice and sought his explanation in this regard.
Details available with Early Times reveal that a person namely Ajit Singh, S/O Baldev Singh, R/O Village Dhar, Tehsil Mughal Maidan, District Kishtwar moved an application dated 23.09.2014 before the PIO/ Tehsildar, Mughal Maidan, District Kishtwar under the Jammu & Kashmir Right to Information Act, 2009 wherein the applicant sought certain information relating to an order passed by the then Tehsildar or any other revenue authority after receiving the order of Financial Commissioner dated 20.01.1968 in the case titled Mangal Singh V/s State.
Ajit Singh received no response from the PIO/Tehsildar Mughal Maidan, District Kishtwar within the prescribed period. The appellant feeling aggrieved of inaction on the part of the PIO as well as First Appellate Authority (FAA) filed second appeal dated 10.02.2015 before the State Information Commission (SIC) Jammu office. The appellant (Ajit Singh) apprised the Commission that he received some information from the Tehsildar, Mughal Maidan, Kishtwar during the pendency of second appeal and the information provided was incomplete, incorrect and not what he sought through his RTI application. The Tehsildar, Mughal Maidan submitted before the Commission that whatever information was available in the office record has been furnished to the appellant.
SIC in its order said, " In the given circumstances, it would be appropriate, if the appellant is allowed an opportunity to inspect the office record to verify the contents of the information already provided to him." The Commission added that there is delay on the part of the PIO,Tehsildar Mughal Maidan in furnishing the information to the information seeker beyond the statutory period. He is hereby directed to show cause why penalty under section 17 of the J&K Right to Information Act, 2009 may not be imposed upon him within two weeks from the date of receipt of this order."
