Shakuntla-Janipur Fly Over: DB asks CS to file affidavit within two weeks

Jammu, May 15: In a Public Interest Litigation (PIL) filed by Citizen Forum through its President RK Chadha regarding fly-over project from Shakuntla-Janipur fly over proposed in 2008 has been abandoned for some extraneous reasons, a Division Bench (DB) of State High Court comprising Justice Hasnain Massodi and Justice Janak Raj Kotwal observed that affidavit is yet to be filed and directed Chief Secretary to file affidavit within two weeks.
After hearing Adv Aditya Sharma for the PIL whereas Sr AAG Gagan Basotra with Deputy AG Ehsan Mirza for the state, the Division Bench observed that in terms of order dated February 19, 2015, Chief Secretary was required to file an affidavit detailing the decisions of the state government yet has to be file the same and directed him to file affidavit within two weeks.
Division Bench further observed that the status report filed by Economic Reconstruction Agency (ERA) would reveal that some steps were taken towards execution of the project i.e. Fly-over from Shakuntla Chowk to Amphalla Chowk having two limbs, 01 km and 0.46 km in length and that connecting limb to New Plot-Janipur Road. Initial steps like publication or acquisition notice dated 07/10/2009 have been taken, consultants engaged to prepare the Detailed Project Report (DPR) but nothing has been done thereafter. Court also observed that the decision was taken to defer the project and to propose funding under future loans.
It also said that the report filed by ERA is not to leading anywhere unless chief Secretary takes a clear and definite stand in the matter.
