HC dismisses plea challenging CJM order to file FIR against police officer

Srinagar, Aug 4: Jammu and Kashmir High Court today dismissed a petition, challenging the Chief Judicial Magistrate (CJM) to direct police to lodge FIR against a senior police officer, accused of killing a youth in his house in the city outskirts on July 10. The CJM, had directed police to file FIR against Deputy Superintendent of Police Yasir Qadri, alleged to have killed Shabir Ahmad Mir inside his Tengpora house on July 10.
However, the government challenged the order of CJM in the High Court. A single bench comprising Justice Mohammad Yaqoob Mir after hearing arguments from both sides, rejected the petition. The CJM on a petition filed by the father of the deceased youth alleging that his son shabir was killed by a police party headed by Dy SP Qadri had on July 18 directed Senior Superintendent of Police (SSP), Srinagar to registered an FIR against the police officer within 24 hours. However, after the petitioner pleaded before the court that no FIR was lodged against the Dy SP, the CJM Masrat Shaheen issued a non bailable warrant against the SSP who was later granted bail on next hearing.
The Chief Prosecuting Officer (CPO) pleaded before the court of CJM that an FIR has already been lodged and investigation has been handed over to SP North City Sajad Khaliq in the case. However, on August 1, as directed the CJM the SSP Srinagar was produced under custody before the court by Deputy Inspector General (DIG) central in the court. The court later granted bail to SSP against the furnishing of bail bonds to the tune of Rs 50000 and personal bonds for the same amount.
The court also directed SSP to file statement of fact on August 2, 2016 and also comply the directions of the court which have been passed by CJM court on July 18 and July 28 and lodge the FIR and file the copy of FIR within 24 hours. However, the government challenged both the orders dated July 18 and July 28 of CJM in the high court after sanctioned accorded by the government on July 29.
