Another jolt to state in dead wood case

Jammu, Feb 23: In another setback to the state government in the compulsory retirement of dead wood, a Division Bench of State High Court Comprising Justice Ramalingam Sudhakar and Justice M K Hanjura dismissed the appeal filed by the State against the judgment passed in Ravi Kumar I/C Executive Officer, JS Tandon MD JKSRTC and Deepak Gupta Transport Manager.
While dismissing the appeal of the State, Division Bench after hearing Sr. AAG HA Siddqui appearing for the State whereas Adv Rahul Pant and Adv Ajay Bakshi appearing for the respondents observed that the order of compulsory retirement shall not be passed as a short cut to avoid departmental enquiry when such course is more desirable.
Division Bench further observed that sphere of the jurisdiction of the Committee was to consider each such cases for compulsory retirement in which the charges of corruption were leveled against each employee. How is that a few employees were picked up for such consideration and the others were allowed to go scot free?
Division Bench further observed that merely that case/cases have been registered against the respondent by the Vigilance Organization cannot form the basis of retiring him compulsorily, as a corollary to which the judgment/order of the Single Judge impugned here in this appeal which is based on the law, reason and the logic does not call for any interference and is, upheld. Therefore, the appeal fails and is accordingly dismissed. There shall be no order as to costs.
