Will erring PIO be penalised?

Srinagar, June 23: Even after Chief Information Commissioners (CICs) orders to reveal information regarding enhancement of wages in favour of some consolidated employees of J&K Projects Construction Corporation (JKPCC), the Public Information Officer (PIO) of the corporation has not provided the information to aggrieved who has now filed a complaint before State Information Commission (SIC) for non compliance of CICs order. Aggrieved and RTI activists have demanded that PIO be taken to task and penalized for disrespecting CICs order which was passed on June 6th 2018 at SICs Srinagar office. Details available with Early Times reveal that on 12.10.2017 information seeker Ghulam Qadir Dar R/O Panzan Budgam filed an RTI application before the PIO(HQ), JKPCC for providing of information related to 30 consolidated workers of the corporation. After a lapse of 30 days the PIO failed to provide the requisite information as per the provisions of J&K RTI Act 2009.On 14/11/2017 Information seeker submitted 1st appeal before the GM (Central) JKPCC who is also the First Appellate Authority (FAA) of JKPCC. The FAA also failed to pass any order against the PIO. The FAA who is a quasi judicial authority neither called appellant Ghulam Qadir now PIO for hearing. On 03/02/2018 aggrieved Ghulam Qadir filed 2nd appeal before J&K State Information Commission Jammu (SIC). An order was issued by CIC Khurshid Ahmad Ganai against the PIO, JKPCC to explain as to why penalty may not be imposed on him for being defaulter for non-submission of required information in favour of the appellant.
The case was again listed before CIC on 06/06/2018. CIC Khurshid Ahmad Ganai heard both the parties & ordered to provide the requisite information within one day positively otherwise penalty of Rs. 25000/- will be imposed upon the defaulter PIO, in light of J&K RTI Act.
